Who is a Patent Agent?
A Patent Agent is a qualified professional registered under the Patents Act, 1970, who is authorized to practice before the Patent Office. Patent Agents play a crucial role in the innovation ecosystem by assisting inventors, startups, research institutions, and companies in protecting their inventions through patents. Their core functions include drafting patent specifications, filing patent applications, prosecuting applications before the Patent Office, responding to examination reports, and assisting in hearings. By ensuring that inventions are accurately and legally protected, Patent Agents help transform ideas into valuable intellectual property assets.
Patent Agent Examination
The Patent Agent Examination is conducted by the Office of the Controller General of Patents, Designs and Trade Marks (CGPDTM), generally on an annual basis, as notified.

Structure of the Examination
- Paper I
The Patents Act, 1970 and the Patents Rules, 2003;
The Designs Act, 2000 and the Designs Rules, 2001. - Paper II
Drafting and interpretation of patent specifications, design specifications, and other related documents.
- Viva Voce
The qualifying examination consists of the following papers:
- A minimum of 50 marks each in Paper I and Paper II; and
- An aggregate of 60% of the total marks to be declared as having passed the examination
